  • Lease ended / tenant moved out voluntarily: If the tenant returned keys or the lease expired and they left belongings, the property is potentially abandoned — but you need to send written notice before disposing of it.
  • Tenant disappeared mid-lease: If rent is unpaid and the unit appears vacated (utilities off, no personal items of daily use), you can post an abandonment notice per §83.59. Once the abandonment is legally established, the §715.104 property-disposal process kicks in.

Step 2: Send Written Notice (Required)

Under §715.104, the landlord must send the former tenant a written notice that includes:

  • A description of the property left behind
  • The address where the property is stored
  • A deadline for the tenant to claim it — at least 10 days if the notice is hand-delivered, or at least 15 days if mailed
  • A statement that the property will be disposed of or sold if not claimed by the deadline

Send the notice to the tenant’s last known address (which may be the rental unit itself if no forwarding address was provided). Keep a copy and proof of mailing — certified mail is strongly recommended.

Step 3: Wait the Full Notice Period

Do not touch the property until the notice period expires. If the tenant claims it within the window, you must release it (you can charge reasonable storage costs).

  • Property valued under $500 (your reasonable estimate): You may dispose of it however you see fit — trash, donate, or keep it. No public sale required. (§715.109)
  • Property valued at $500 or more: You must sell it at a public sale (after advertising it). Proceeds go to cover your costs first; any surplus goes to the county treasury. (§715.109(4))
